1. Our Identity & Your Agreement

Agreement: These Terms, together with our Shipping & Returns Policy and Privacy Policy, constitute the entire agreement between you (“Customer,” “Collector,” “You”) and Steinbach Shop (“we,” “us,” “our”).

2. Product & Service Description

We specialize in authentic, handcrafted Christmas collectibles designed to become cherished family heirlooms.

• Product Categories: Accessories, Big Nutcrackers, Christmas Pyramids, Chubby Nutcrackers, Limited Nutcrackers, Music Boxes, Ornaments, Smokers.
• Product Characteristic: Each piece is crafted with meticulous attention to detail, emphasizing tradition, artistry, and longevity. Limited Nutcrackers are exclusive, often numbered editions, making them unique and irreplaceable collectibles.
• Service Scope: We ship globally but currently cannot serve some remote locations or specific regions in Asia. Product availability is subject to change.
• Visual & Descriptive Accuracy: We strive for accurate product images and descriptions. Slight variations in color or finish due to the handmade nature and your display settings are inherent to the artistry and do not constitute a defect.

3. User Obligations & Responsibilities

By using our site, you agree to:

• Provide accurate, current, and complete information during account creation and checkout.
• Use the website only for lawful purposes and not engage in any activity that disrupts its functionality.

4. Ordering, Pricing & Payment Terms

Order Process:

• Placing an item in your cart does not reserve it. An order is only confirmed once we send an order confirmation email.
• We reserve the right to refuse or cancel any order for reasons including, but not limited to, product availability, errors in pricing, or suspected fraud.

Pricing:

• All prices are listed in USD (US Dollars).
• Prices are subject to change without notice but will not affect confirmed orders.

Payment Methods:

We accept secure payments via: Visa, MasterCard, JCB, and PayPal.

• Payment is processed at the time of order confirmation.
• By providing payment information, you represent that you are authorized to use the chosen method.

5. Shipping Policy

• Processing: Orders are prepared within 1-2 business days after payment confirmation.
• Methods & Costs:
  • Standard Shipping (DHL/FedEx): Flat fee of $12.95 USD. Estimated delivery: 10-15 business days after dispatch.
  • Free Economy Shipping (EMS): Available for orders over $50 USD. Estimated delivery: 15-25 business days after dispatch.
• Delivery Times: Are estimates only. Delays may occur due to customs, weather, or peak seasons. You will receive a tracking number upon dispatch.
• Risk of Loss: Title and risk of loss for products pass to you upon our delivery to the carrier.

6. Returns, Refunds & Exchanges

Our goal is your complete satisfaction. Our full policy is on the Shipping & Returns page. Key conditions include:

• Return Window: 15 days from the date of delivery.
• Condition: Items must be unused, in original packaging, and in resalable condition with all accessories and certificates.
• Process: You must contact us first at [email protected] to obtain an RMA number before returning any item.
• Non-Returnable Items (Final Sale): All sales in the “Limited Nutcrackers” category are final. Additionally, personalized items, or items not in original condition, are not eligible for return.
• Refunds: Issued to the original payment method within 10 business days of our receipt and inspection of the return. Original shipping fees are non-refundable unless the return is due to our error.
• Damaged Items: Report damage or defects within 48 hours of delivery for a prepaid return and replacement/refund.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Steinbach Shop or its content suppliers and is protected by international copyright and trademark laws.

The “Steinbach Shop” name, logo, and all related product names, designs, and slogans are trademarks of Steinbach Shop. You may not use these marks without our prior written permission. The overall look and feel of the site (the “trade dress”) is also our proprietary property.

8. Limitation of Liability

Steinbach Shop, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service.
• Any conduct or content of any third party on the service.
• Any content obtained from the service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Delays or failures in delivery due to factors beyond our reasonable control (force majeure), including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Our total liability to you for any claim arising out of or relating to these terms or your purchase, regardless of the form of the action, is limited to the greater of $100 USD or the amount you have paid us for the product in the last 12 months.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the site shall be subject to the exclusive jurisdiction of the state and federal courts located in Marion County, Indiana.
